What is a Will?
A will – sometimes called a last will and testament or just a will – is an estate planning tool that allows you to outline what you want to be done with your property and responsibilities when you pass away. Although every estate plan is unique, most estate plans will include a will to describe how to distribute property to beneficiaries.
Important pieces of property to consider when drafting a will include:
- Real estate
- Automobiles
- Valuable personal property
- Heirlooms
- Financial accounts
- Business ownership
- Stocks and market shares
- Investments
Wills can also describe how your responsibilities should be handled by other people. For example, you can include a legal guardianship clause in your will that establishes a guardian for your children or adult dependents with special needs.
What is an Advance Directive?
An advance directive, sometimes called a living will, is another important estate planning tool that can be used alongside a will to pre-decide what medical care you want to receive when you cannot make those decisions any longer. It is recommended that anyone who is making an estate plan make an advance directive because medical preferences are so important to peace of mind. Also, your family will appreciate not having to decide on your medical care without your input, which can take significant stress off their shoulders.
- Medical preferences in your Living Will: You can list your medical treatment preferences if you cannot communicate due to a terminal condition or if you are in a persistent vegetative state.
- Additional medical directives in your Durable power of attorney for healthcare: You should use a medical durable power of attorney to name who can make medical decisions for you regarding anything that was not covered by your advance directive. After all, it is impossible to predict with 100% accuracy what sort of medical care you’ll need in the future.
