What is Probate?
Probate is the legal process through which a deceased person's estate is administered and distributed. It involves validating the will, if one exists, settling debts, and distributing the remaining assets to the heirs. What is the Probate Process?
In Colorado, the probate process will usually include these basic steps:
- Submit the will to probate court: If a will exists, it's submitted to the probate court for validation. If no will is present, the court appoints someone to manage the estate.
- Appoint personal representative: The will typically names a personal representative, formerly called “executor” to oversee the probate process. .

- Pay debts and taxes: Outstanding debts and taxes owed by the estate are paid using the estate's funds, so all financial obligations are settled before distributing assets.
- Distribute remaining assets to beneficiaries: Once debts and taxes are cleared, the remaining assets are distributed to the beneficiaries according to the will's instructions or state law if no will exists.

Ways to Minimize Probate

- Designate beneficiaries: Naming beneficiaries for accounts like life insurance policies, retirement accounts, and payable-on-death bank accounts allows these assets to transfer directly to the designated people or parties upon your death. This direct transfer process can avoid probate in most cases, allowing beneficiaries to access the assets more quickly and without additional legal hurdles.
